Samsung: Patent case, we won't get a penny from Apple.

Samsung and Apple’s second round of patent litigation in the United States came to a close on Friday, and the two companies have won each other.

The eight-member jury ruled that Samsung’s products infringe on two Apple patents and should pay $119.6 million, which is less than the $2.2 billion that Apple had previously requested. The jury also found that Apple infringed a Samsung patent and ordered a payment of $158,400. This amount is also far below the $6.2 million that Samsung had previously requested.

In response, the quick-talking Samsung lawyer John Quinn said in an interview with CNET, a US technology information website, that Samsung may have lost, but it is still a winner because Apple will not get a penny through trial.

Quinn also predicted that Apple may stop in the patent litigation because of the inability of the company to reverse the market demand for Android smartphones.

Quin said: "At this stage, I think Apple has not given up the hope of messing up Android. The lawsuit that just ended is their last straw, they must realize that the prosecution of the opponent can not delay the development of Android."

Quinn is a partner at Quinn Emanuel Urquhart & Sullivan, whose clients include Samsung, Google and other Android handset manufacturers. In November last year, the company participated in the retrial of the first round of Apple Samsung patent infringement on behalf of Samsung. In addition, they also reached a settlement on behalf of HTC and Apple on patent disputes. In the near future, they will also meet Motorola and Apple again in court.

Quinn said: "Apple has spent so much money on the lawsuit, but it has not been effective. I am sure that Apple is looking for a step to exit. I am quite sure that Apple's smartphone has no way out for the war initiated by Android."

Apple declined to comment on the report. The agency's external legal counsel did not respond to the request for comment.

In addition, the judgment of mutual infringement is not as clear as before. Some legal experts said that this can be regarded as Samsung's victory. First, the compensation awarded to Apple was much lower than expected. Second, Samsung did not infringe all five patents, and Apple was also convicted of infringing on a Samsung patent. This situation has never been seen before.

Quinn said: "We regard it as a victory. Apple launched a jihad against Android for several years, but one did not get it."

This time Samsung is also not planning to make a claim, and its plan to erase this $119.6 million in damages through an appeal. In addition, Samsung also plans to appeal the results of the first round of judgment. Quin believes that by appealing, even if the full compensation cannot be waived, the amount of compensation can be greatly reduced. In the last round of the match with Apple, Samsung was awarded 930 million US dollars.

At the same time, Quinn expects that the ongoing patent infringement war will end in the near future. The US District Court Judge Lucy Koh, who has handled this series of cases, also hopes that the two companies can resolve the dispute through out-of-court settlement.

During the trial, Apple’s late co-founder Steve Jobs’ email showed that Apple was going to launch a “jihad” against Android. Quin said: "It is very difficult to reach a settlement with the jihadists. Even so, I think that Apple’s current CEO, Cook, has to realize that this is a battle without results. I think everyone is tired of it. At some point, reason often prevails."
